At Abiva Publishing House, Inc. (“Abiva,” “we,” “us”), we value your trust. For more than 80 years, we have supported schools, teachers, parents, and learners through quality instructional resources. As we expand our services both in print and digital, we remain committed to handling your personal data responsibly, securely, and transparently.

This Privacy Policy explains what personal data we collect, why we collect it, how we use and safeguard it, and the rights you have regarding your data, in accordance with the Data Privacy Act of 2012 (RA 10173), its Implementing Rules and Regulations, and the guidelines issued by the National Privacy Commission (NPC).

We process personal data based on your consent, the performance of a contract (such as order processing and delivery), compliance with legal obligations, and Abiva’s legitimate interests, provided these do not override your rights and freedoms.

This policy applies to our products, services, websites, forms, and activities that do not have a separate privacy notice.

What Personal Data We Collect and Why

We collect only the personal data that is necessary to deliver our products and services, respond to your inquiries, and meet legal and business requirements. Whenever possible, we clearly explain why we need your information at the point of collection.

Your personal data is securely stored in both digital and physical formats within Abiva’s local servers, systems, and recordkeeping facilities. We maintain these records to ensure accuracy, accessibility, and continuity of service.

How We Share Your Personal Data

We may share your personal data only when necessary and only for legitimate business purposes, such as: 

     a) Processing orders and payments
     b) Delivering products or services
     c) Responding to your requests

Personal data may be disclosed to authorized Abiva employees, affiliates, or trusted third-party service providers who are contractually required to protect your data. We do not share your personal data with external parties without your consent, unless disclosure is required or allowed by law. 

Third-Party Categories: When necessary, we may share personal data with trusted service providers such as logistics partners, IT and cloud service providers, and other vendors who assist us in delivering our products and services.  These parties are contractually required to protect your personal data.

How We Retain and Dispose of Your Personal Data

We retain your personal data for six (6) months up to three (3) years from the date of your transaction or inquiry, or until the purpose for collection has been fulfilled.

In certain cases, we may retain data longer when required by law or for legitimate business purposes. Once no longer needed, personal data is securely disposed of or destroyed.

In the event of a personal data breach that may pose a risk to your rights and freedoms, Abiva will notify affected data subjects and the National Privacy Commission in accordance with the Data Privacy Act and NPC rules.

How We Protect Your Personal Data

We implement appropriate organizational, physical, and technical safeguards to protect your personal data against loss, misuse, unauthorized access, disclosure, alteration, or destruction.

These measures include:

Terms of Use

Platform Overview

  • The Power Builders Tracker is a monitoring tool that helps schools record and track students’ progress within the Power Builders Reading Program.
  • Administration is limited to authorized educators and institutions.

Permitted Use

  • The software use is restricted to Power Builders progress tracking only.
  • Users must keep credentials secure and report any unauthorized access.
  • Accounts may be suspended or terminated for misuse.

Data Privacy & Ownership

  • Student data collected is limited to reading progress and is processed in compliance with the Data Privacy Act of 2012.
  • Data may be stored locally or synced to users’ secure cloud systems.
  • Schools remain responsible for lawful retention and stakeholder notification.
  • Student performance data belongs to the institution.

User Restrictions

  • Users may not share accounts, reverse engineer the system, upload false data, or use the platform for commercial/unlawful purposes.
  • Platform is provided “as is”; Abiva Publishing House, Inc. (APHI) has limited liability.
  • Abiva is not liable for losses arising from platform use, access issues, or device-related data loss, to the extent allowed by law.

Third-Party Services

  • The software may use third-party hosting providers that are compliant with data protection standards.

Updates & Acceptance

  • Abiva may update the software or terms with notice.
  • Continued use constitutes acceptance of updates.

Legal

  • Terms are governed by Philippine law; disputes are subject to the Quezon City courts’ jurisdiction.
